General Terms and Conditions
Article 1 – Definitions
For the purposes of these terms, the following definitions apply:
Withdrawal period: the period within which the consumer may exercise their right of withdrawal;
Consumer: a natural person who is not acting in the course of a profession or business and enters into a distance contract with the trader;
Day: a calendar day;
Performing transaction: a distance contract relating to a series of goods and/or services, the delivery and/or obligation to receive of which is spread over time;
Durable data medium: any medium that allows the consumer or the trader to store information addressed personally to the consumer in a way that allows it to be consulted in the future and reproduced without alteration;
Right of withdrawal: the consumer's right to withdraw from the distance contract within the withdrawal period;
Trader: the natural or legal person who offers goods and/or services to consumers at a distance;
Distance contract: a contract in which, within a system organized by the trader for the distance sale of goods and/or services, only one or more means of distance communication are used until the conclusion of the contract;
Means of distance communication: any means that can be used to conclude a contract without the consumer and the trader being in the same place at the same time;
General Terms and Conditions: these General Terms and Conditions of the trader.
Article 2 – Identity of the trader
Article 3 – Applicability
These General Terms and Conditions apply to all offers from the trader and to all distance contracts and orders between the trader and the consumer.
Before the conclusion of the distance contract, the text of these General Terms and Conditions shall be made available to the consumer. If this is not reasonably possible, the consumer shall be informed before the conclusion of the contract that the General Terms and Conditions can be consulted at the trader's premises and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these general terms and conditions will be made available electronically so that the consumer can easily save it on a durable medium. If this is not possible, it will be indicated where they can be consulted and that they will be sent free of charge upon request.
If, in addition to these general terms and conditions, specific product or service terms and conditions apply, the provisions of the preceding paragraphs will apply, and the consumer may always rely on the most favorable provision in the event of any conflict.
If one or more provisions of these terms and conditions are invalid or voidable, the contract and the remaining terms and conditions will remain in full force and effect, and the invalid or voidable provision will be replaced by another that most closely approximates its purpose.
Situations not covered by these terms and conditions will be governed by their spirit.
Any ambiguity in interpretation will be resolved according to the spirit of these terms and conditions.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be clearly stated.
The offer is non-binding. The trader may modify the offer.
The offer contains a complete and accurate description of the products and/or services offered. The images used accurately reflect the products or services. Obvious errors do not bind the trader.
Products may differ slightly in color from the images.
Each offer contains information about the consumer's rights and obligations upon accepting the offer, including: price (excluding import costs), shipping costs, method of contract conclusion, existence of the right of withdrawal, payment, delivery, contract filing, consumer data verification, available languages, applicable codes of conduct, and minimum duration in the case of a transaction.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and fulfills the conditions. If accepted electronically, the trader will confirm receipt immediately.
The business will take technical and organizational measures to protect data transmission and ensure a secure environment for electronic payments.
The business may verify the consumer's ability to meet their payment obligations and refuse orders if there are reasonable grounds.
The business will provide information on: the address for complaints, withdrawal conditions, warranties and after-sales service, information regarding Article 4, and cancellation requirements for contracts with a duration of more than one year.
Article 6 – Right of Withdrawal
The consumer may withdraw from the contract within 14 days without giving any reason, starting from the day after receiving the product.
During this period, the consumer must handle the product with care.
If the consumer exercises this right, they must return the product.
with all accessories and, to the extent reasonable, in its original packaging, following the clear instructions of the trader.
The consumer must notify the trader in writing or by email of their intention to withdraw within 14 days and return the product within the following 14 days.
Article 7 – Costs in case of withdrawal
The costs of return shipping will be borne by the consumer. The trader will refund the amount paid within a maximum of 14 days after receiving the product or proof of return.
Article 8 – Exclusion of the right of withdrawal
The right of withdrawal may be excluded for personalized, personal, non-returnable, perishable, market-fluctuating, periodical, software, or opened hygiene products, as well as for certain services (accommodation, transport, leisure, gambling).
Article 9 – The price
The prices indicated are valid for the duration of the offer, except for changes in VAT or prices subject to market fluctuations.
Typographical errors do not bind the business.
Article 10 – Conformity and Warranty
The business guarantees that the products comply with the contract, specifications, and applicable regulations. The manufacturer's warranty does not affect the consumer's statutory rights.
Defects must be reported within 14 days. The warranty does not cover repairs carried out by third parties or damage caused by misuse.
Article 11 – Delivery and Performance
The business will process orders with the utmost diligence and, unless otherwise agreed, within 15 days.
In the event of a delay or inability to deliver, the consumer may cancel the order free of charge and receive a refund within 14 days.
The risk of damage to or loss of the product remains with the business until delivery to the consumer or their designated representative.
Article 12 – Contracts of Indefinite Duration: Term, Cancellation, and Renewal
The consumer may cancel contracts of indefinite duration at any time with a maximum notice period of one month.
Fixed-term contracts may only be canceled at the end of the agreed period.
Contracts are not automatically renewed, except in certain cases for newspapers and magazines with maximum terms of three months.
Article 13 – Payment
Payments must be made within 7 days of the start of the withdrawal period.
The consumer must notify the company of any errors in their payment information. In the event of non-payment, the company may charge reasonable fees.
Article 14 – Complaints Procedure
Complaints must be submitted within 7 days of discovering the defect.
The company will respond within 14 days.
If the complaint is valid, the product will be replaced or repaired free of charge.
